1. The service

Topo Art lets you upload activity files (such as GPX files), connect third-party accounts like Strava, customize the appearance of a route, and export or purchase high-resolution images (“Posters”) based on that data. We may add, change, or remove features at any time.

2. Eligibility & accounts

You must be at least 16 years old, or the age of digital consent in your jurisdiction, to use the Service. If you create an account, you are responsible for keeping your login credentials secure and for all activity that occurs under your account. Please notify us promptly of any unauthorized use.

3. Your content & activity data

You retain ownership of the activity data, GPX files, and other content you upload or import (“Your Content”). By using the Service, you grant us a limited, non-exclusive license to process, store, and display Your Content solely to operate and provide the Service to you — for example, rendering your route and generating a Poster.

You represent that you have the rights to Your Content and that it does not infringe the rights of any third party or violate any law.

4. Third-party integrations

If you connect Strava or another third-party service, you authorize us to access and import data from that service on your behalf, in accordance with the permissions you grant. Your use of those services remains subject to their own terms and privacy policies. We are not responsible for third-party services and may lose access to them at any time, which could affect related features.

5. Purchases, pricing & refunds

Previewing a Poster is free. Downloading a high-resolution Poster requires a one-time payment at the price shown at checkout. Payments are processed by our third-party payment provider (Stripe); we do not store your full payment card details.

Because Posters are digital goods delivered immediately, all sales are final once the high-resolution file has been generated and made available for download. If something goes wrong with your order — a failed download, a corrupted file, or a charge you don’t recognize — contact us and we’ll make it right.

6. License to your poster

When you purchase a Poster, we grant you a worldwide, perpetual license to use, print, and share the resulting image for personal, non-commercial purposes, including ordering prints for yourself or as gifts. If you would like to use a Poster commercially, please contact us first.

7. Our intellectual property

The Service itself — including our software, design, themes, templates, logos, and branding — is owned by Topo Art Studio and protected by intellectual property laws. These Terms do not grant you any rights in our intellectual property except as expressly described.

8. Acceptable use

You agree not to:

• Upload content you do not have the right to use;
• Reverse engineer, scrape, or attempt to disrupt or circumvent the Service or its security;
• Use the Service to create or distribute unlawful, infringing, or harmful material;
• Resell or redistribute the Service or access to it without our written permission.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that maps, route lines, or activity metrics will be accurate. Posters are intended for decorative and personal use and should not be relied upon for navigation.

10. Limitation of liability

To the maximum extent permitted by law, Topo Art Studio will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $50.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination — including ownership, disclaimers, and limitations of liability — will survive.

12. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. Any disputes will be resolved in the state or federal courts located in California, and you consent to their jurisdiction.
